Personal Injury claims arises when one party is negligent and this negligence leads to the physical injury of another person. The negligence must result in an injury to another person or persons. Negligence without an injury is not actionable. To show that another party was negligent it must be proven that the responsible party owed a duty of care to others, failed to exercise that duty of care (breached), that injuries resulted to another person from that breach of the duty of care and that those injuries were a foreseeable result of the breach of duty of care.
